Jusqu’en 2010, le contrôle de constitutionnalité de la loi en France était exclusivement a priori et sur saisine d’autorités politiques. L’entrée en vigueur de la QPC, permettant au justiciable d’alléguer, au cours d’un procès ordinaire, la contrariété de la loi applicable à ses droits et libertés constitutionnels, a donc été saluée comme mettant fin à une exception française au sein du modèle européen de justice constitutionnelle. Pourtant, aucune mise en perspective de cette nouvelle procédure avec celles existant dans les pays proches n’avait été entreprise à ce jour. L’ouvrage y remédie à travers une comparaison systématique des questions de constitutionnalité en France, Espagne et Italie, élargie de façon plus ponctuelle à d’autres exemples (Allemagne et Belgique). Les atouts et faiblesses des différents mécanismes nationaux sont mis en lumière par l’analyse successive des procédés de filtrage de la question, du jugement de la Cour constitutionnelle et de ses suites ainsi que de l’insertion de la question dans l’environnement juridictionnel global. La comparaison invite en définitive à une réflexion plus générale sur l’évolution des systèmes de justice constitutionnelle à l’heure de la pluralité des juges des droits fondamentaux. L’ouvrage présente les résultats d’une recherche de deux ans, menée par une équipe de chercheurs originaires des trois pays principalement étudiés, et soutenue par la Mission droit et justice (Ministère français de la justice – CNRS). Il est enrichi du compte-rendu des débats et discussions intervenus lors du colloque final de cette recherche qui s’est tenu en 2013 à la Faculté de droit d’Aix-en-Provence.

Breyer, Associate Justice of the United States Supreme Court, discusses these dilemmas in the context of recent Supreme Court decisions and offers suggestions for addressing them. In order to bring economic reasoning to bear in legal fields, such as antitrust law, intellectual property law, and economic regulation, Justice Breyer recommends the following: The law must take into greater consideration the underlying human purposes of the law, rather than simply favor strict legal categories. Courts should consider using independent experts for economic reasoning in technical areas rather than sending judges to economic seminars. These experts should understand the role that administrative considerations, such as the need for rules, play in the law. Given the law's reluctance to rely upon novel approaches, institutions outside the judiciary should debate and adopt economic methods for the courts to model. The legal process, Justice Breyer argues, "is too important to be left simply to the legal specialists, to the lawyers, or even to the judges." Those with basic economic or regulatory policymaking expertise need to participate in the judicial process. A European public law is under construction, but how has this occurred and what is its character? Stirn proposes that this European public law is being constructed by the convergence of three circles: the law of the European Union, the law of the European Convention on Human Rights, and the different domestic legal orders.
